Terms of Service

These Terms of Service ("Terms") govern your use of the SmartOptions application ("App") provided by NerdLabs ("we", "us", "our"). By installing or using SmartOptions, you agree to be bound by these Terms.

1. Service Description

SmartOptions is a Shopify application that enables merchants to add custom product options, including text fields, dropdown menus, color/image swatches, file uploads, conditional logic, and price add-ons to their online store products.

2. Account & Eligibility

• You must have an active Shopify store to use SmartOptions.
• You must be at least 18 years old or the age of majority in your jurisdiction.
• You are responsible for maintaining the security of your Shopify account.
• You agree to provide accurate and complete information during installation.

3. Subscription & Billing

• Free Trial: SmartOptions offers a 14-day free trial with full access to all features. No credit card is required to start.
• Pricing: After the trial, the subscription is $7.99/month (USD), billed through Shopify's billing system.
• No Tiers: All features are included in the single plan. There are no hidden fees or premium tiers.
• Cancellation: You may cancel your subscription at any time through your Shopify admin. Cancellation takes effect at the end of the current billing cycle.
• Refunds: Since billing is handled by Shopify, refund policies follow Shopify's standard terms. Contact us at support@nerdlabs.us for billing issues.

4. Acceptable Use

You agree not to:

• Use the App for any illegal or unauthorized purpose.
• Reverse engineer, decompile, or disassemble the App.
• Attempt to gain unauthorized access to our systems or other users' data.
• Use the App to distribute malware or harmful content.
• Resell, sublicense, or redistribute the App without our written consent.
• Interfere with or disrupt the App's functionality or infrastructure.

5. Intellectual Property

SmartOptions, including its code, design, and documentation, is the intellectual property of NerdLabs. Your subscription grants you a limited, non-exclusive, non-transferable license to use the App for your Shopify store. You retain full ownership of your store's content and data.

6. Data & Privacy

Our collection and use of data is governed by our Privacy Policy. By using SmartOptions, you consent to the data practices described therein. We access only the Shopify data necessary to provide our service (products, orders containing custom options, and theme information).

7. Availability & Support

• We strive to maintain 99.9% uptime but do not guarantee uninterrupted service.
• We may perform maintenance that temporarily affects availability, with advance notice when possible.
• Support is available via email at support@nerdlabs.us. We aim to respond within 4 hours during business hours.

8. Limitation of Liability

To the maximum extent permitted by law, NerdLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use SmartOptions. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

9. Disclaimer of Warranties

SmartOptions is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free or that defects will be corrected.

10. Indemnification

You agree to indemnify and hold harmless NerdLabs, its officers, and employees from any claims, losses, or damages arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via the App or email. Continued use of SmartOptions after changes constitutes acceptance of the updated Terms.

12. Termination

We may suspend or terminate your access to SmartOptions if you violate these Terms. Upon termination, your right to use the App ceases immediately. Sections on liability, indemnification, and intellectual property survive termination.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration.
